AML & KYC policy

How Forests Market screens participants and verifies identity before a purchase.

01 Purpose and commitment
Forests Market and the issuers are committed to preventing money laundering, terrorist financing and sanctions evasion. Onboarding and continued access are conditioned on satisfactory identity verification (KYC) and anti-money-laundering (AML) checks. We operate a risk-based program and reserve the right to refuse, delay, freeze or unwind any transaction on compliance grounds.
02 Legal framework
- United States — the Bank Secrecy Act, OFAC sanctions programs and related rules applicable to the offering.
- Costa Rica — Law 7786 (as amended), including the registration of obligated subjects under articles 15 / 15 bis before SUGEF, with reporting to the UIF/ICD.
Registration as an obligated subject is an AML/CFT registration, not a banking license. See the Payments policy for how funds are handled.
03 Customer due diligence (KYC)
Before you can subscribe we verify, at minimum:
- Identity — legal name, date of birth/formation, nationality/jurisdiction, address, and government-issued identification, with a liveness check where required.
- Eligibility — accredited-investor or Regulation S status, and investor categorization.
- Beneficial ownership and control — for entities, the natural persons who own or control them.
- Source of funds and wealth — the origin of the funds used to invest.
We may request additional documentation and may re-verify at any time. Providing false information is grounds for refusal or offboarding.
04 Sanctions and PEP screening
We screen investors, beneficial owners and relevant counterparties against applicable sanctions lists (including OFAC) and for politically-exposed-person (PEP) status, at onboarding and on an ongoing basis. We do not deal with sanctioned persons or persons in prohibited jurisdictions.
05 Ongoing monitoring and eligibility
We conduct ongoing monitoring and periodic re-screening. Eligibility is decided in our internal register before any Token exists, and only eligible, KYC-verified, platform-held wallets can receive or hold Tokens — the eligibility register is the on-chain transfer control that enforces these restrictions. A sanctions re-screening hit or other compliance concern can result in a position being frozen pending review.
06 Suspicious activity and reporting
We report suspicious activity to the competent authorities (for example the UIF/ICD in Costa Rica) within required timeframes and do not “tip off” the subject of a report. We maintain a designated compliance officer, staff training and independent periodic review.
07 Record-keeping
We retain KYC/AML records, screening results and transaction records for the periods required by applicable law (generally at least five years after the end of the relationship). See the Privacy & cookie policy for how personal data is handled.
08 Consequences and contact
Failure to complete verification, or a materially adverse finding, may result in refusal, suspension, a freeze, or offboarding, and in the return of funds only to the verified originating account where lawful. Compliance queries: info@forests.vc.
